Bookniverse Terms and Conditions

1.Age requirements
If you’re under the age required to manage your own Bookniverse Account, you must have your parent or legal guardian’s permission to use a Bookniverse Account. Please have your parent or legal guardian read these terms with you.
If you’re a parent or legal guardian, and you allow your child to use the services, then these terms apply to you and you’re responsible for your child’s activity on the services.
a. Who is Bound by this Agreement
This Agreement applies to all users of our Services, including "Merchants" (organizations or individuals that use our Services to manage voucher promotion programmes for their customers under a Selected Subscription Plan) and "Customers" (individuals that use our Services to understand and manage their vouchers with one or more Merchants). References to "Users" means individual end users of the Services, including every employee, representative, consultant, contractor or agent of a Merchant, every Customer and every other end user.
"You" and "your" refers to you, if acting in your individual capacity, or the legal entity on whose behalf you are entering into this Agreement if you are acting on behalf of another legal person. If you are an individual entering into this Agreement in your personal capacity, including as a Customer or a Merchant that is a sole proprietor, or you are also a User. If you are a User acting on behalf of another legal person, such as a corporation, you represent that you have the power to bind that legal person. You will ensure compliance with this Agreement by each employee, representative, consultant, contractor or agent who uses the Services on your behalf. If you are a Merchant, that includes any User who creates an account associated with you ("Account").
While you may access the Services through another platform, such as a platform with which the Platform is integrated, this Agreement nonetheless applies to your use of our Services.
2.Develop, improve, and update Bookniverse services
We’re constantly developing new technologies and features to improve our services. For example, we use artificial intelligence and machine learning to provide you with simultaneous translations, and to better detect and block spam and malware. As part of this continual improvement, we sometimes add or remove features and functionalities, increase or decrease limits to our services, and start offering new services or stop offering old ones.
If we make material changes that negatively impact your use of our services or if we stop offering a service, we’ll provide you with reasonable advance notice, except in urgent situations such as preventing abuse, responding to legal requirements, or addressing security and operability issues.
3.Service-related communications
To provide you with our services, we sometimes send you service announcements and other information. To learn more about how we communicate with you, see Bookniverse’s Privacy Policy.
4.Content in Bookniverse services
Some of our services include content that belongs to Bookniverse — for example, many of the visual illustrations you see in Bookniverse website. You may use Bookniverse’s content as allowed by these terms and any service-specific additional terms, but we retain any intellectual property rights that we have in our content. Don’t remove, obscure, or alter any of our branding, logos, or legal notices.
Some of our services give you access to content that belongs to other people or organizations — for example, a book displayed in Bookniverse. You may not use this content without that person or organization’s permission, or as otherwise allowed by law. The views expressed in other people or organizations’ content don’t necessarily reflect Bookniverse’s views.
5.In case of problems or disagreements
Both the law and these terms give you the right to (1) a certain quality of service, and (2) ways to fix problems if things go wrong.
6.Warranty
We provide our services using reasonable skill and care. If we don’t meet the quality level described in this warranty, you agree to tell us and we’ll work with you to try to resolve the issue.
7.Disclaimers
The only commitments we make about our services (including the content in the services, the specific functions of our services, or their reliability, availability, or ability to meet your needs) are provided in (1) the Warranty section; (2) the service-specific additional terms; and (3) laws that can’t be limited by these terms.
8.Liabilities
i.For all users
Both the law and these terms try to strike a balance as to what you or Bookniverse can claim from the other in case of problems. That’s why the law allows us to limit certain liabilities — but not others — under these terms.
These terms only limit our responsibilities as allowed by applicable law. These terms don’t limit liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence or willful misconduct.
Other than the liabilities described above, Bookniverse is liable only for its breaches of these terms or applicable service-specific additional terms, subject to applicable law.
ii.For business users and organizations only
If you’re a business user or organization:
To the extent allowed by applicable law, you’ll indemnify Bookniverse and its directors, officers, employees, and contractors for any third-party legal proceedings (including actions by government authorities) arising out of or relating to your unlawful use of the services or violation of these terms or service-specific additional terms. This indemnity covers any liability or expense arising from claims, losses, damages, judgments, fines, litigation costs, and legal fees.
If you’re legally exempt from certain responsibilities, including indemnification, then those responsibilities don’t apply to you under these terms. For example, the United Nations enjoys certain immunities from legal obligations and these terms don’t override those immunities.
iii.Bookniverse won’t be responsible for the following liabilities:
loss of profits, revenues, business opportunities, goodwill, or anticipated savings
indirect or consequential loss
punitive damages
9.Taking action in case of problems
Before taking action as described below, we’ll provide you with advance notice when reasonably possible, describe the reason for our action, and give you an opportunity to fix the problem, unless we reasonably believe that doing so would:
  • cause harm or liability to a user, third party, or Bookniverse
  • violate the law or a legal enforcement authority’s order
  • compromise an investigation
  • compromise the operation, integrity, or security of our services
10.Suspending or terminating your access to Bookniverse services
Bookniverse reserves the right to suspend or terminate your access to the services or delete your Bookniverse Account if any of these things happen:
  • you materially or repeatedly breach these terms, service-specific additional terms or policies
  • we’re required to do so to comply with a legal requirement or a court order
  • we reasonably believe that your conduct causes harm or liability to a user, third party, or Bookniverse — for example, by hacking, phishing, harassing, spamming, misleading others, or scraping content that doesn’t belong to you
You’re always free to stop using our services at any time. If you do stop using a service, we’d appreciate knowing why so that we can continue improving our services.
11.Settling disputes, governing law, and courts

These Terms and Conditions will be governed by and construed in accordance with the laws of the Hong Kong, without giving effect to any principles of conflicts of law.
12.About these terms
i.By law, you have certain rights that can’t be limited by a contract like these terms of service. These terms are in no way intended to restrict those rights.
ii.These terms describe the relationship between you and Bookniverse. They don’t create any legal rights for other people or organizations, even if others benefit from that relationship under these terms.
iii.If these terms conflict with the service-specific additional terms, the additional terms will govern for that service.
iv.If it turns out that a particular term is not valid or enforceable, this will not affect any other terms.
v.If you don’t follow these terms or the service-specific additional terms, and we don’t take action right away, that doesn’t mean we’re giving up any rights that we may have, such as taking action in the future.
vi.We may update these terms and service-specific additional terms (1) to reflect changes in our services or how we do business — for example, when we add new services, features, technologies, pricing, or benefits (or remove old ones), (2) for legal, regulatory, or security reasons, or (3) to prevent abuse or harm.
vii.If we materially change these terms or service-specific additional terms, we’ll provide you with reasonable advance notice and the opportunity to review the changes, except (1) when we launch a new service or feature, or (2) in urgent situations, such as preventing ongoing abuse or responding to legal requirements. If you don’t agree to the new terms, you should remove your content and stop using the services. You can also end your relationship with us at any time by closing your Bookniverse Account.
13.Unauthorized Access to Accounts. You must keep your account details secure and must not share them with anyone else. You must not collect or harvest any personal data of any user of Bookniverse including account names.
14.Disabled Accounts. If Bookniverse disables access to your account in accordance with the Terms (for example if you violate the Terms), you may be prevented from accessing Bookniverse, your account details or any files or other Content that is stored with your account.
15.Purchases and Payments
Bookniverse may allow you to view Content free of charge on Bookniverse. Additional limitations may apply to your access and use of certain free Content.
Your contract for the purchase and use of Content is completed once the content is made available to you and you will be charged for the purchase at that time, and performance of this contract begins as soon as the purchase is complete.
Pricing. Pricing and availability of all Content displayed through Bookniverse are subject to change at any time prior to purchase.
All Sales Final. If a replacement, return or refund is granted for any transaction, the transaction may be reversed, and you may no longer be able to access the Content that you acquired through that transaction.
16.Rights and Restrictions
i.License to Use Content. After completing a transaction for Content, you will have the non-exclusive right, solely as expressly permitted in these Terms and associated policies, to store, access, view, use, and display copies of the applicable Content on your Devices or as otherwise authorized for your personal, non-commercial use only. All rights, title and interest in
Bookniverse and Content not expressly granted to you in the Terms are reserved.
Violation of License Terms. If you violate any of the Terms, your rights under this license will terminate immediately, and Bookniverse may terminate your access to Bookniverse, the Content or your Bookniverse Account without refund to you.
ii.Restrictions: You may not:
  • display (in part or in whole) the Content as part of any public performance or display even if no fee is charged except (a) where such use would not constitute a copyright infringement or violate any other applicable right or (b) as specifically permitted and only in the exact manner provided.
  • sell, rent, lease, redistribute, broadcast, transmit, communicate, modify, sublicense, transfer, assign any Content to any third party including with regard to any downloads of Content that you may obtain through Bookniverse except as specifically permitted and only in the exact manner provided.
  • use Bookniverse or any Content in conjunction with any stream-ripping, stream capture or similar software to record or create a copy of any Content that is presented to you in streaming format.
  • use Content as part of any service for sharing, lending or multi-person use, or for the purpose of any other institution, except as specifically permitted and only in the exact manner provided.
  • attempt to, or assist, authorize or encourage others to circumvent, disable or defeat any of the security features or components that protect, obfuscate or otherwise restrict access to any Content or Bookniverse.
  • remove any watermarks, labels or other legal or proprietary notices included in any Content, or attempt to modify any Content obtained through Bookniverse, including any modification for the purpose of disguising or changing any indications of the ownership or source of Content.
User policies for Bookniverse
Our policies play an important role in ensuring a positive experience for both Books on Bookniverse users and publishers. These policies are subject to change, so please check back for updates.
Managing Your Books on Bookniverse
Rights - Once you've purchased an eBook from Bookniverse, it is available to you in your Bookniverse account. While you have the right to access your eBook, please note that the copyright still resides with the eBook's rights holder, usually the publisher or author who submitted the title to Bookniverse. In certain cases, we may be forced to remove customer access to content stored online. However, any downloads that you have obtained will continue to work, even if we're no longer able to provide online access to an eBook.
Sharing - You may not lend or co-own any of your Books on Bookniverse purchases with another person.
Purchase Policies
  • Refunding Books on Bookniverse
    No refunds are provided unless the content is defective. If the ebook does not perform as described, you may return it for a refund at any time. Refunds will not be granted in situations of purchase abuse. When a refund is granted, we'll remove access to the eBook and your money will be returned.
  • To submit a refund request, please contact our Bookniverse Customer Support.
Privacy and Security Policies
  • My Library
    Following purchase, all eBooks will be stored on your 'Purchased' bookshelf. This shelf is automatically marked 'Private', meaning that its contents are not viewable to other Bookniverse eBooks users, and it cannot be made public. You may not remove eBooks from your 'Purchased' shelf unless you wish to delete an eBook permanently from your account. In addition to the 'Purchased' shelf, eBooks will also appear on your 'My Books on Bookniverse' shelf. This shelf stores any eBooks that you are syncing to mobile devices. By default, this shelf is marked 'Private', and it cannot be made public.
  • Copyright and Digital Rights
    Many eBooks are protected under copyright law and our publisher and author partners require us to protect them against unauthorised copying and abuse. This protection comes in the form of digital rights management (DRM) and controls your usage of your eBooks. This protection is specified by the publisher and Bookniverse is required to implement it.
  • Some Books on Bookniverse are completely free of digital rights management - they are either free public-domain books or the rights holder has chosen to provide their readers with full access to the content. In these cases, you will be able to download DRM-free ePubs or PDFs. For all other eBooks, we will implement rights management as required by publishers to protect these files. In addition, some publishers will limit the number of mobile readers that can download a specific book at a time and will limit the number of concurrent reading sessions allowed for their content. At this point, it is not possible to view the digital rights settings for individual books.
  • Order History
    Your purchase history may be viewed by Bookniverse for technical troubleshooting and/or support purposes. We understand that your purchase history is a personal information and our highest priority is to maintain the security and confidentiality of this data. To do this, we use a variety of measures to safeguard your data. We also have internal restrictions on who can access your data at Bookniverse.
  • Privacy
    Please view our Privacy Policy for information about how we handle your personal information.
  • Lost Devices
    Should you lose your mobile device with eBooks stored on it, you can always resync your purchases onto another device. Since all your purchases are automatically stored in the cloud (on your "My Purchased eBooks" shelf), you never have to worry about losing your eBooks.
  • Account Security
    You are responsible for maintaining the confidentiality of your passwords associated with any Bookniverse Account that you use to access your books on Bookniverse. You are also responsible for all activities that occur under your accounts. If you believe that your Bookniverse account security has been compromised or if you are a non-Bookniverse customer reporting unauthorised charges for this service, please contact Bookniverse Support.
  • Account Suspensions
    Your account may be suspended in cases of egregious policy violations or if we're unable to verify your account's payment details. If you believe that your account has been suspended, please contact Bookniverse Support.
  • Content Complaints
    Offensive Content
    Our eBook content spans a wide range of interests and subjects, including topics which may be controversial and potentially offensive. We understand that our users have many different points of view, and you may disagree with certain material or find it to be inappropriate. Please rest assured that we will take appropriate action for any content that we find to be in violation of our publisher content policies. For more information, please view our Publisher Policies.
  • User-Generated Content
    All user-generated content is subject to our Publisher Policies.
  • Reporting Abuse
    Our publisher policies play an important role in ensuring a positive experience for both Books on Bookniverse users and our publishing partners. For this reason, we take reports of policy violations or abuses very seriously. If you find potentially abusive content or inappropriate user behavior, please contact our team.
